UK legal regulator warns solicitors on AI risks

The Solicitors Regulation Authority (SRA), the UK's legal sector regulator, has issued a stern warning to solicitors and law firms regarding the safe and responsible use of artificial intelligence (AI). The SRA highlighted two primary areas of concern that could lead to breaches of regulatory and legal obligations, according to Infosecurity magazine

The SRA's warning notice, published on August 17, addresses the risks of AI "hallucinations" and data leaks. Concerns have been raised about AI generating incorrect information for court submissions and the inadvertent disclosure of confidential client data into public AI tools. 

These issues can result in poor client outcomes, delays in legal proceedings, and damage to public trust. The regulator emphasized that solicitors remain accountable for AI-generated output and must ensure appropriate human oversight and professional judgment. Firms are urged to implement robust governance structures to manage AI risks. 

Submitting false case law citations generated by AI could lead to contempt of court charges. Furthermore, inputting client information into public AI systems, whether free or paid, is likely to breach confidentiality unless adequate safeguards are in place, stressing that client data must always remain secure.
