EU watchdog seeks criminal action against Clearview AI

Austrian prosecutors have received a new criminal complaint against US-based facial recognition company Clearview AI

The complaint was filed by the European Center for Digital Rights on October 28 for allegedly ignoring enforcement orders from several EU data protection authorities, Infosecurity Magazine reports.

Clearview AI, which claims to hold over 60 billion facial images scraped from public sources, has long argued that it falls outside the EU’s General Data Protection Regulation (GDPR) because it has no operations within Europe. 

However, regulators in the Netherlands and other countries maintain that the company must comply since its database contains Europeans' data. 

Noyb said the complaint leverages Article 84 of the GDPR, which allows criminal sanctions beyond administrative fines, potentially exposing the firm's executives to jail time or arrest if they travel to Europe. Max Schrems, honorary chairman of noyb, accused Clearview AI of "spitting in the face of EU authorities" for repeatedly defying European privacy rulings.
